Dear Expert,

 Issued the lc with deliver terms as ' Ex-works China ( Incoterms 2010)' .

But in commercial invoice mentioned as Ex-works Shanghai, China (Incoterms 2010)

We have noted as discrepancy mentioning Incoterms inconsistent in Comm. Invoice but beneficiary's bank refuse to accept the discrepancy.

Is this would be considered as discrepancy? Can we reject the beneficiary's bank message?

This is not a valid discrepancy. It could noit be argued in a court of law that EXW Shanghai China is not EXW China.

Incoterm discrepancy

Hello,

 

I think you will have to accept the documents if this is the only discrepancy as the LC was issued incorrectly. Usually ex works goes with the city and not the country.

No discrepancy

Hi Friend,

IMHO, not a discrepancy.

If l/c indicated FOB any Chinese Port(Incoterms 2010),do  you will refuse an invoice stating FOB Shanghai(Incoterms 2010) and complied with bill of lading?
