spare parts of goods.

Dear all,

Case one:

If goods description under L/C does not mention Spare parts (e.g. stating 5 units of xx brand machine )

Now presented invoice and other documents showing goods description including spare parts.

Is it valid to raise discrepancy of “Docs showing spare parts of goods which are not called for by L/C?”

Case 2.

If L/C does not mention goods description including spare parts.

Presented invoice showing goods description WITHOUT mentioning spare parts, but other docs including packing list and B/L have shown goods including spare parts.

Is that acceptable?

Thanks for valuable opinons.

I see it a lot like Sam

Case one: The spare parts are part of the  machine (I immediately thought of laser and inkjet printers not of cars, but they also go with spare ink/toner cartridges). So there follow Sam's advice.

Case two:

However, I feel that the documents must be coherent and matching each other.  Not to mention the spare parts in the invoice but to mention them in the packing lists is a discrepancy.

Spare Parts

Case 1: Invo?ce can not ?nclude goods wh?ch aren't ment?oned ?n LC (even ?f they are free), see ISBP2007 art. 64B. so th?s ?s d?screpant

Case 2: If LC doesn't ment?on any spare parts and ?nvo?ce ?s complyed w?th th?s. There ?s not any rule to proh?b?t g?v?ng add?t?ons for goods on docs. other then ?nvo?ce (of course the descr?pt?on ?n these docs. must not confl?ct?ng w?th the LC as art.14E of UCP600)so that would be acceptable.

spar Parts

1. It is a discrepancy. If spare parts, which is not called in LC mentioned on invoice will be considered as a discrepancy.

2.If invoice omits to show spare parts - not a discrepancy, If Packing list, B/L shows the exact quantity of invoice including spare parts then not a discrepancy.... If it shows the quantity of spare parts which is not covered in invoice then it will be a discrepancy.

Cheers!!!!!

spare parts

You can not play with Description of Goods on Invoice, but in addition you can mention on Packing List. Even I wont suggest you to mention spare parts on BL.

spare parts of goods - L/c Amendment is suggested

There should be consistency between all the docs.
In my opinion, if applicant has no problem and is agreeing to amend the L/c, ask him to amended the L/c suitably.

Ther is a way to work around this and comply with the credit.

The merchandise description appears to be a general merchandise description  of "5 units of xx brand machine".  What can be done is as follows: The merchandise description can read 5 units of xx brand machine consisting of ... and then listing the parts of each machine.

Think of it in this way.  When a car is sold, it is normally understood that the car comes with many accesories, even a spare tire. So if the merchandise description shows "5 cars" in the credit, the documents could show a shipment of cars including floor mats, spare tire, a radio, etc. It is all how you define the car in the document.  A sample wording would be..

5 cars each consisting of a motor, tires, body, spare tire, radio, floor mats, etc.

Since all of these items are in the car, they are considered part of the car. So careful wording of documentation can still make the documents comply with the credit.
