Dear all,

3 photocopies of bills of lading (stamped and hand signed) were presented to us by the nominated bank along with the other required dox.

Are these photocopies considered to be originals, or discrepant dox

In NO case photocopies are acceptable in lieu of Originals, whatsoever docs are.

What I understand from your comments that instead of typing many copies of B/Ls (for negotiable & non-negotiable purpose), only one copy was typed and photocopy was taken before signature. one (or two//three) of such copy is marked "Original" & "Negotiable" and signed manually.

In this case, B/L presented by you is OK. Pl carify your question.

Photocopies are not acceptable in lieu of original.

If B/L presented comply with UCP 600 article 20, then it is acceptable.

Photocopies are not considered as original BL

These photocopies are not considered as original bill of lading. If the shipping company has already issued a original bill of lading, they will not give a photocopy of original with stamped and hand signed copies.

 

 

If your L/C calling for the copy of B/L for negotiation is acceptable. It is not a discrepancy. In other words discrepancy will generating if you are not fulfilling the l/c conditions.

As per Art 17 b) of UCP 600 quote "A bank shall treat as an original any document bearing an apparently original signature, mark, stamp, or label of the issuer of the document, unless the document itself indicates that it is not an original. "
Hopefully, your B/Ls are marked as "Original" or "Negotiable" and earlier no original B/L was issued. In view of abv in my opinion, abv B/L is OK

If...

If the photocopies have an original signature, mark, stamp or label of the issuer, it is an original and the documents comply with the credit.

If the photocopies has only a photocopied signature, mark, stamp or label of the issuer, it is not original and the documents do not comply with the credit.

I completely agree with Sam

There is no rule prohibiting to "ennoble" a photocopy to an original by signing and stamping it in original.
