1) description of goods: QTY:SHTS 5.000 M3:53.582 U/P:USD 660.00 (QUESTION: do i really need to follow exactly the wordings and figure format? esp 5.000 instead of 5,000 and U/P? coz my invoice showing heading as PER M3.
2) B/L issued OR endorsed to the order of "name of issuing bank" (QUESTION : do we need to indicate the name of issuing bank at the back of B/L upon endorsement? coz it states "ISSUED OR ENDORSED..."
3) lc asking for shipment advice showing shipment details ETC. (QUESTION : is it ok to ignore the word "ETC"?)
4) in general, is the negotiating bank very particular with the punctuation marks? i meant, do i really need to follow every details in the lc in terms of commas, full stop, apostrophe?
sorry for the very simple questions that for me needs clarifications.
lastly can i have a soft copy of ISBP 2007, UCP600 and INCOTERM 2000? my email add is : arnitagorres@yahoo.com
your comments and reply is highly appreciated.thanks in advance
Description of the goods to corresponds to the LC though not a mirror image but when collated together must correspnds to the LC goods description. Unit price/trade term to correspond exactly as per LC. By this you should change the invoice to M3 i/o PER M/3 and 5.000 i/o 5,000. Banks always see the invoice as per LC. they need not know the exact interpretation as per your trade.
2.Understand B/Ls can be issued either "to the order of 'issuing bank'" or "to the order and endorsed in the back to issuing bank". so if you choose the second option you must indicate the name of issuing bank at the back.
3.As long as you give normal shipping details e.g vessel name,qty,b/l date,b/l no the "etc" has no further relevance.normally you should avoid these terms in LC which is ambiguous and ask for amendment if it is there.
4. depends on where it appears if a change in punctuation or apostrope change the meaning of cargo description, value, qty then you have to follow as per LC otherwise it is inconseqential.
As you are aware on this site, we have made some painful experiences with the ICC and the guys claiming a copyright to the ISP 98. It is rather unique that uniform customs and practices as well as practices once written down become copyrightable with the result that you have to pay to support the scribes.
However, it is considered "fair use" under US copyright law to comment article by article and publish the text. This commentary will hopefully be published by end of the year.
I tried to do the same ("...to comment article by article and publish the text...."), but just to be on the safe side, asked for copyright permission from the ICC. They only permitted reproduction of 20% of the UCP 600 Rules, no more. ICC insisted that I use not more than 20% of the text of the UCP 600 for being quoted in my book. It was like discussing Paris without invoking the names of the Eiffel Tower or the Louvre!
The use of the legal text (here UCP 600) when commenting should of course be covered by fair use (section 107 of the US copyright law which I attempt to quote from memory). That the ICC is so adamant only shows how desperate they are for money.
On another note, my father wrote a commentary on the UCP 500 (the English translation of which you find above under articles) and I believe also for his book on the UCP 600, the ICC contacted him.
I don't think that he asked for permission.
On another note, the ICC headquarter in Paris is a membership organization. Whenever I asked who actually holds the copyright, the national Chamber of commerce organizations or the Paris headquarter, nobody responded (I exchanged emails with German based and Paris based lawyers).
It is patently absurd that an organization can claim copyright to "customs and practices". But I believe in the electrical industry codes of best practices exist and again an organization claims copyrights to it.
In which sense you rate my post as world's most boring posting..............?? It, of course, made me laugh, but I couldn't understand what do you wanted to say.
Any way ICC Bookstore offers it for 30 €.
Kindly, the one who is having, mail me the ISBP 681, 2007 addition,.

Well – I just think that writing such a post as I just did there is such a bore – so it was in fact a reference to my own post … I think that these strict copyright rules on books like the UCP and ISBP makes no sense at all. However – I like to follow the discussions on this forum – and if somebody get the idea that the site is used for exchanging copyrighted material without paying the copyright holders – this may in the end damage the site. So I guess what I am trying to say is that I hated writing that post – but felt that I had to.
Adel
I can't understand the ICC-price-politics either.Their rip off-prices are even high for German levels, how can anyone bear them who only earns USD 2000 or USD 4000 a year.
"Possession obliges"
Schiller - "Wilhelm Tell"
Nevertheless, this open and excessive soft copy sharing of protected contents might cause all of us more harm than use.
You can believe me that I am vehemently opposed to the copyright claimed by the ICC and the Institute of International Banking Law & Practice. Basically they copyright standard and uniform practices. However, currently it seems that this is the law.
With that in mind, anyone offering ICC material on this forum will be banned and the post erased.
Since the ICC does not enforce its copyright consistently, (I nearly feel honored that they selected this forum for enforcement) members of the forum have to google the material they are looking for.
Also, regarding the UCP 600, once time permits, I will publish a commentary similar to what is already published for the UCP 500. (The ICC could only be convinced with great difficulties to accept the notion of "fair use" and allow academic discussions of the UCP 500 as published above).
Anyone: when the ICC claims copyright: which organization exactly owns the copyright ? I have talked to some Germans, some French ? Nobody gives me any answer. Adel, you seem to have closer ties. Any hints ?
I agree that the prices are rip-offs. Their insistance on copyright to the Rules & Publications appear to be silly and self-defeating. On the one hand they want to promote the use and understanding of the ICC Rules. On the other, they put up artificial barriers in as many ways as they can - by way of copyright restrictions, prohibitive prices and so on.
I understand that they receive funds from the UN, their members and other sources. Why they have to exploit the UCP/ISBP/URR/URC and such like, beats me!
Can you imagine your country's Civil Procedure Code being under copyright, or the Contract Act, Sales of Goods Act etc.?
Finally, Dear Admin, with regard to your comment, "The ICC could only be convinced with great difficulties to accept the notion of "fair use" and allow academic discussions of the UCP 500 as published above", my experience tells me that they are NOT willing to accept the notion of fair use if you are going to quote more than 20% of the concerned Rules and go on to make commercial use of the commentaries you publish. Discussions on this forum would, surely, be OK.
