Confirmation Required or not?????

3. One set of Non Negotiable documents to be sent to applicant

My Question is that

As per clause 46A (3) confirmation certificate or any evidence (courier receipt) is required or not?  as you know LC is not asking for any documents or evidence but this clause belong to 46A Documents Required

Hi,

This could fall under UCP 600, sub-article 14(h): credit contains condition without stipulating document to indicate compliance with the condition. You are not required to submit any evidence.

No evidence required

If you have quoted 46a 3 in full, then you have no requirement to present any evidence that non negotiable documents have been sent to the applicant.

I would caution you, however, about complying with this requirement.  There may be very good reasons for the buyer needing to see documents (arranging insurance, collection of goods etc.) but, in my experience, many buyers only want to see the documents to try and find discrepancies and notify the nominated bank accordingly.

I would try and get behind the reason for the buyers request and only provide copies of those documents are actually needed for the shipment logistics.
